South County Renourishment Project Perpetual Easements Critical
Another important element of the project is the federal requirement for perpetual construction easements along the project area, which are separate and distinct from the additional public beach access (with associated parking) needed to increase the project’s federal participation.
A USACE prerequisite for construction, these perpetual construction easements (which run parallel with the shoreline) are required from every property along the beach, allowing legal access to traverse and place sand within private property.
Preliminary efforts to notify residents of these easements have commenced and future efforts required to draft/execute these construction easements will follow accordingly.
It should be noted that land owner cooperation is necessary for the dedication of these easements, and that an estimated 100% of the property owners along the beach side must comply with this USACE requirement to ensure the project can move forward. Without full participation, the USACE has indicated it would likely withdraw its participation, thus killing the entire 50-year project. With this in mind, a fair and equitable funding plan is essential to maintaining support for this effort and the proposed project as a whole.
PERPETUAL CONSTRUCTION EASEMENTS HAVE BEEN SENT CERTIFIED MAIL TO ALL LAND OWNERS ADJACENT TO THE PROJECT AREA AND MUST BE EXECUTED (BY THE PRESIDENT, VICE PRESIDENT, OR CHIEF EXECUTIVE OFFICER), WITNESSED, AND RETURNED BY THOSE LAND OWNERS PRIOR TO FEBRUARY 1, 2021. PERPETUAL CONSTRUCTION EASEMENTS ARE A PREREQUISITE FOR FEDERAL CONSTRUCTION AND MUST BE IN PLACE PRIOR TO BIDDING THE PROJECT!
